We represent lenders in commercial loan document preparation, secured and unsecured loan work-outs, and litigation related to these issues. Because of our strong emphasis on real property matters, we provide a wide range of experience in handling mortgage-related issues such as judicial and non-judicial foreclosures (including unified foreclosures), title defects, and title insurance coverage issues. Our firm has addressed a wide range of disputes involving attacks against real estate collateral. We also provide an array of services in general commercial law for our banks, thrifts, credit unions and related regulated entities.

Experience Includes:

  • Lender representation regarding commercial creditors’ rights and commercial litigation that covers various aspects of debt recovery, including recovery on guarantees and work-out agreements, litigation, provisional remedies (such as receiverships, attachments and claim and delivery) and post-judgment enforcement.
  • Collection on defaulted unsecured business loans, including seeking recovery through writs of attachment on available assets.
  • Disputes concerning the value of loans sold and demands made for repurchase including loan origination issues and defending lenders when the claim is the lender knew the loan would go bad.
  • Pursuing motions for relief from the bankruptcy automatic stay on defaulted secured real estate business loans.
